Seattle Long-Term Disability Insurance Lawyer

Suffering a long-term disability can derail your plans, your life as you know it, and the future you’ve envisioned for yourself. If you have long-term disability coverage in place, it can provide you with the financial assistance you need if your recovery stretches from a period of several months to several years – or until you reach the age of retirement – depending on the policy terms. While the time frame is set by the policy itself and policies vary, having this financial safety net during your time of need can provide you with considerable peace of mind.

If you’re facing a concern related to your long-term disability coverage, it’s time to consult with an experienced Seattle long-term disability insurance lawyer

Long-Term Disability Insurance

Long-term disability (LTD) insurance is private insurance, and when it’s provided by your employer, it’s regulated by the Employee Retirement Income Security Act (ERISA).

Long-term disability insurance is generally quite expensive, and many people gain coverage through their employers – who offer it as part of a benefits package that helps them attract the right employees. ERISA’s focus is ensuring that this coverage remains in accordance with strict federal rules and regulations regarding:

  • The funding and administration of benefit plans
  • Minimum employee eligibility requirements
  • The correct disclosure of information to employees

Claims administration is usually delegated to the insurance company, which is required to administer the benefits according to the parameters set forth by ERISA.

Your LTD Coverage

If you’re unable to work for an extended period due to an injury or illness that has nothing to do with your job, LTD benefits will cover a specific portion of your lost monthly income. Because LTD benefits vary from policy to policy, it’s an excellent idea to familiarize yourself with your coverage.

Filing for LTD

If you have an LTD claim, timely filing is critical, and there are a number of important stages involved, including:

  • Notifying the insurance provider
  • Submitting the necessary documentation
  • Responding to any of the insurer’s questions and additional requirements
  • Updating the insurer regarding your medical care, including information related to any new activity in terms of medical testing, medications, and chart notes

When an LTD Claim Is Denied

If you have an illness or injury that’s keeping you off the job and you have LTD coverage, it’s time to file a claim. If your claim is denied, however, you may have no idea where to turn for the help you need. The fact is that it’s not uncommon for LTD claims to be denied up-front, but an experienced long-term disability lawyer can help.

The problem may be something as simple as the insurance company needing more medical information, but it’s not always that easy. Insurance companies are fully invested in turning huge profits, and if they can get away with seriously limiting or even denying a claim, they will. There is no penalty under ERISA for an insurer to wrongfully deny a claim.  Thus they have an incentive to deny claims with minimal repercussions. You will quite likely need an experienced attorney by your side during the process.  You have one opportunity to appeal under ERISA, and six months after the denial to submit that appeal.  Once an appeal is submitted, the insurer is not obligated to review any additional information.  Further, if you want to bring suit over the denial, the court will often not consider information not submitted to the insurer in the appeal.  Getting the appeal right is a key step in obtaining the benefits owed to you.   You want to have assistance at the appeal stage — if you wait until you want to bring a lawsuit, you are limiting the ways in which your attorney can help you by improving the claim file in your favor.
