Can You Work Part-Time While Receiving Long-Term Disability Benefits?

Home//Blog//Can You Work Part-Time While Receiving Long-Term Disability Benefits?

It is often possible to work part-time while receiving long-term disability (LTD) benefits, but doing so is complex and requires careful navigation of your policy’s specific terms. Many LTD policies have provisions that allow for some level of work, especially if your earnings remain below a certain threshold. However, returning to work in any capacity can put your benefits at risk if not handled correctly. Understanding the fine print of your policy and seeking guidance is crucial before making any decisions that could jeopardize your financial stability. Monahan Tucker Law is here to help you navigate this process and ensure the best possible outcome.

How Does Working Affect My LTD Benefits?

Most LTD policies contain a provision that allows you to earn a certain amount of income while still receiving benefits. This is often referred to as a “partial” or “residual” disability clause. The primary factor is how much you can earn before your benefits are reduced or terminated. Typically, insurers will allow you to earn up to a certain percentage of your pre-disability earnings, often 60% to 80%. Once your combined income from work and disability benefits exceeds your pre-disability earnings, your benefit payments will likely be reduced. Exceeding the policy’s earning limit altogether could lead to a termination of benefits.

What Is the “Own Occupation” vs. “Any Occupation” Distinction?

This is one of the most critical aspects of your LTD policy, especially when considering a return to work.

  • Own Occupation: During an initial period (usually the first 24 months), your policy likely defines disability as being unable to perform the material duties of your own specific job. During this time, you might be able to work in a different, less demanding role without it immediately impacting your benefits, as long as you cannot perform your original job.
  • Any Occupation: After the initial period, the definition of disability often shifts. You must then prove that you are unable to perform any occupation for which you are reasonably suited by education, training, or experience. Working part-time can make it much harder to prove you cannot work in “any occupation,” giving the insurer a reason to terminate your claim.

What Should I Do Before Returning to Work?

Taking on part-time work while on LTD is a significant step that requires careful planning. An insurance company will see your return to work as a sign that your condition has improved, and they may use it as a reason to review or terminate your claim. Before you start any form of employment, it is vital to:

  1. Review Your Policy Thoroughly: You must understand the exact language regarding partial disability, residual disability, and any earnings limitations.
  2. Consult Your Doctor: Discuss your plans with your doctor. Ensure they agree that you are only capable of part-time work and that this limitation is well-documented in your medical records.
  3. Seek Legal Counsel: An experienced LTD attorney can review your policy, explain the potential risks, and help you create a strategy that protects your benefits. This step is crucial to avoid unintended consequences.
